Terms of Use and End User License Agreement

1. Provider
Peptly is provided by mehrbytes GbR, Mika Ramsl and Mats Ramsl. You can contact us at info@mehrbytes.com. These Terms govern the use of the Peptly app and the related website at peptly.mehrbytes.com.

2. Subject of the App
Peptly is a personal peptide tracking and health journal app. The app allows users to document routines, reminders, notes, progress entries, and estimated health-related information.

Peptly does not provide medical advice in any form. The app is intended exclusively for general orientation and personal documentation. Peptly does not replace advice, diagnosis, treatment, dosage instructions, or supervision by doctors, pharmacists, or other medical professionals.

3. No Medical Recommendations
Information, notices, reminders, health-related values, trends, and calculations shown in Peptly are based on user input, optional connected data sources, and technical estimates. They may be incomplete, inaccurate, delayed, or unsuitable for your individual situation. They must not be understood as medical recommendations, health advice, dosage guidance, or binding safety instructions.

Users are responsible for assessing their own health decisions and following professional medical guidance. If you have health questions, symptoms, side effects, medication questions, or any uncertainty, you should seek medical advice.

4. Internet Connection and Third-Party Data
Some features of Peptly require an active internet connection, especially features that sync purchases, load account-related information, or use external services. If your device is offline, if network access is unavailable, or if your mobile data allowance is exhausted, parts of the app may be limited or unavailable.

Health-related information or connected data may be provided by external data sources or derived from user input. Although Peptly aims to present useful information, these data sources and estimates may be delayed, incomplete, unavailable, or inaccurate. Peptly does not guarantee that any health-related data is correct, complete, or suitable for a specific situation.

5. Use of the App
The app may only be used in accordance with applicable laws and these Terms. Users must not misuse, manipulate, reverse engineer, scrape, automate access to, or use the app for unlawful purposes.

6. Journal Content and User Input
Users may store personal information and journal content in Peptly, such as routines, tracking times, notes, reminders, estimated health-related values, locally selected photos, or similar information.

This personal journal content remains stored locally on the user's device. Peptly does not upload, review, analyze, or otherwise process user-added photos, tracking times, session data, notes, health entries, or similar personal entries on its own servers. Users are responsible for the accuracy of the data they enter. Peptly does not guarantee that displays derived from user input are complete, correct, or suitable for a specific situation.

7. Availability, Updates and Technical Changes
Peptly is provided with reasonable care. However, uninterrupted, error-free, or permanent availability is not guaranteed. Features may be changed, expanded, restricted, or removed where this is necessary for technical, legal, or business reasons.

Peptly may require updates to remain secure, compatible, or functional. We do not guarantee that the app will remain compatible with all older iOS, Android, device, or operating system versions indefinitely. We may stop supporting outdated versions of the app or certain operating systems where this is necessary for technical, security, legal, or business reasons.

8. Paid Features and Subscriptions
Peptly may include free and paid features. Paid features may be unlocked through in-app purchases or subscriptions.

For purchases through the Apple App Store or Google Play Store, the terms of the respective store provider also apply. Subscriptions renew automatically depending on the selected model unless they are cancelled in time through the settings of the respective store provider.

Managing, cancelling, and requesting refunds for App Store or Play Store purchases is generally handled through the relevant store provider.

9. Prices and Changes
The applicable prices are shown in the App Store or Play Store. Prices may vary depending on country, currency, taxes, and store requirements.

Peptly may change prices or the scope of services for future billing periods. Existing subscriptions are handled according to the rules of the respective store provider.

10. Withdrawal and Refunds
Digital content, in-app purchases, and subscriptions may be subject to special statutory and store-specific rules. Refund requests for purchases through Apple or Google should generally be directed to the relevant store provider.

11. Rights in the App
All rights in Peptly, including design, text, graphics, source code, trademarks, logos, and other content, remain with the provider or the respective rights holders.

Users receive only a personal, non-transferable, revocable right to use the app within the scope of these Terms.

12. Apple End User License Agreement
If Peptly is downloaded through the Apple App Store, the Apple Media Services terms and Apple's standard end user license agreement also apply, unless a different agreement is effectively included.

13. Liability
Peptly accepts no liability for damage resulting from users understanding the app as medical advice, misinterpreting notices, relying on inaccurate health-related estimates, or conditions changing at short notice.

By using Peptly, users acknowledge that Peptly and its developers are not responsible for adverse effects, health decisions, dosage decisions, or treatment decisions made in reliance on the app. The information provided by the app is for informational purposes only and should be used together with the user's own judgment and professional medical guidance where appropriate.

Liability for damage to life, body, or health remains unaffected. Mandatory statutory liability also remains unaffected.

14. External Services
Peptly uses external technical services, including services for hosting, analytics, error diagnostics, and payment processing. Further information is available in the Privacy Policy at peptly.mehrbytes.com/privacy.

15. Privacy
Information about the processing of personal data is available in the Privacy Policy at peptly.mehrbytes.com/privacy.

16. Changes to these Terms
Peptly may update these Terms where necessary due to technical, legal, or business changes. The current version will be made available on the website.

17. Applicable Law
The laws of the Federal Republic of Germany apply, unless mandatory consumer protection rules provide otherwise.
